OVERVIEW
This website is operated by Con Arte PR. Throughout the Site, the terms “Con Arte,” “we,” “us,” and “our” refer to Con Arte PR.
Con Arte offers this website, including the information, products, services, tools, and features available through it, conditioned upon your acceptance of these Terms of Service and all policies referenced herein.
By visiting the Site, placing an order, registering for a workshop, purchasing a service, or otherwise using the Site, you agree to be bound by these Terms of Service.
If you do not agree with these Terms, you should not access the Site, place an order, or use our services.
Our online store is hosted and powered by Shopify, which provides the e-commerce platform that enables us to offer products and services to you.
1. ELIGIBILITY AND ONLINE STORE USE
By using the Site, you represent that you are at least the age of majority in your place of residence or that you are using the Site with the involvement and permission of a parent or legal guardian.
You may not use the Site, our products, or our services for any illegal, fraudulent, abusive, or unauthorized purpose.
You may not:
- Violate applicable laws or regulations
- Submit false or misleading information
- Interfere with the security or proper operation of the Site
- Introduce viruses, malware, or other harmful code
- Attempt to gain unauthorized access to accounts, systems, or information
- Scrape, copy, reproduce, or exploit Site content without permission
- Use the Site to harass, threaten, impersonate, or harm another person
We may suspend or terminate access to the Site when these Terms are violated.
2. PRODUCTS AND SERVICES
Con Arte offers handmade soaps, candles, bath and body products, hair-care products, artisan goods, workshops, educational materials, mentoring services, and other products or services described on the Site.
Products and services may be available in limited quantities and may be modified or discontinued at any time.
Availability is not guaranteed until an order has been accepted and processed.
We reserve the right to limit quantities, restrict resale purchases, discontinue products, or decline transactions for legitimate and lawful business reasons.
3. HANDMADE PRODUCT VARIATIONS
Many Con Arte products are individually handmade or produced in small batches.
Slight differences may occur in:
- Color
- Shape
- Size
- Weight
- Texture
- Pattern
- Decoration
- Fragrance appearance
- Placement of botanicals or other decorative elements
- Packaging or labeling
Product photographs are representative. Lighting, photography, screen settings, handmade production, and natural ingredient variations may cause the product received to appear slightly different from the image displayed.
Natural handmade variations are not considered defects and do not qualify for a return, replacement, exchange, or refund.
4. PRODUCT INFORMATION
We make reasonable efforts to provide accurate product descriptions, ingredients, sizes, weights, prices, photographs, and availability information.
Approximate weights and measurements may vary slightly because of the handmade nature of our products.
Customers are responsible for reviewing product descriptions, ingredient information, usage instructions, warnings, and other information before purchasing or using a product.
We reserve the right to correct typographical errors, inaccurate information, pricing mistakes, or omissions.
5. PERSONAL-CARE PRODUCT USE
Our personal-care products are intended for their stated cosmetic, cleansing, conditioning, aromatic, or personal-care purposes.
Product descriptions and educational content are provided for general informational purposes and are not medical advice.
Our products are not represented as being intended to diagnose, treat, cure, or prevent any disease or medical condition.
Customers should:
- Review the complete ingredient list before use
- Avoid ingredients associated with a known allergy or sensitivity
- Follow the directions and warnings provided
- Perform a patch test when appropriate, particularly when there is a history of skin sensitivity
- Discontinue use if irritation or an adverse reaction occurs
- Seek guidance from an appropriate healthcare professional when necessary
Individual experiences, preferences, and reactions may vary. Con Arte does not guarantee that a product will produce the same results for every person.
Nothing in this section limits rights or remedies that cannot legally be excluded.
6. PRICES AND PAYMENT
All prices are displayed in United States dollars unless otherwise stated.
Prices, promotions, product descriptions, and availability may change without notice before an order is placed.
Applicable taxes, shipping charges, and other fees will be displayed during checkout when required.
Customers agree to provide complete, current, and accurate billing, shipping, payment, and contact information.
Payment information is processed through Shopify and the applicable payment provider. Con Arte does not directly store complete credit or debit card numbers.
7. ORDER ACCEPTANCE
Submitting an order does not guarantee that it will be accepted or fulfilled.
We may review, hold, limit, or cancel an order for legitimate and lawful reasons, including:
- Product unavailability
- An obvious pricing or listing error
- Incomplete or unverifiable information
- Payment authorization problems
- Suspected fraud or unauthorized activity
- Unusually large quantities that appear intended for unauthorized resale
- Violation of these Terms or another Con Arte policy
- An order that we are legally unable to fulfill
If Con Arte cancels an order after payment has been collected, the applicable amount for the canceled item or order will be refunded to the original payment method.
We may contact the customer using the email address or telephone number provided with the order when additional information is needed.
8. FINAL SALES, CANCELLATIONS, AND ORDER CHANGES
All sales are final once an order has been placed.
Con Arte does not accept customer-requested cancellations, order changes, exchanges, or refunds after an order has been submitted.
Customers must carefully review the following before completing checkout:
- Products
- Quantities
- Sizes
- Fragrances
- Variations
- Personalization details
- Shipping address
- Contact information
- Payment information
We do not guarantee that separate orders can be combined or that items can be added, removed, replaced, or modified after purchase.
If Con Arte is unable to fulfill an order, the applicable amount will be refunded to the original payment method.
If an unexpected delay prevents us from shipping within the stated or legally applicable period, we will communicate with the customer and provide any options required under applicable law.
Our complete Refund, Return & Exchange Policy is incorporated into these Terms by reference.
9. DAMAGED, DEFECTIVE, OR INCORRECT ITEMS
Customers should inspect their orders promptly after delivery.
An item that appears damaged, defective, or different from the product ordered must be reported to Con Arte within 3 calendar days of the delivery date and in accordance with our Refund, Return & Exchange Policy.
A report may require:
- The order number
- Clear photographs of the product
- Photographs of the reported damage or issue
- Photographs of every side of the shipping container
- Photographs of the interior packaging
- A photograph of the shipping label
- A description of the issue
- Additional photographs, videos, or documentation requested during the review
The customer must retain the product, shipping container, and all original packaging while the report is under review.
The product must not be discarded, used, altered, repaired, cleaned, or returned unless Con Arte provides instructions.
Submitting photographs or a report does not automatically guarantee a replacement, store credit, partial refund, or full refund.
All reports are subject to reasonable review and approval by Con Arte.
A report may be denied when:
- Required information is incomplete, unclear, or insufficient
- The condition reported cannot be reasonably verified
- The product or packaging is unavailable for review
- The product has been used, altered, repaired, cleaned, or discarded
- The documentation is inconsistent
- The damage appears to have occurred after delivery
- The damage resulted from improper handling, misuse, storage, heat, moisture, weather exposure, or another condition occurring after delivery
- The report was submitted after the applicable reporting period
When a report is approved, Con Arte will determine an appropriate resolution based on the circumstances, available evidence, product availability, carrier requirements, and applicable law.
10. SHIPPING
Ready-to-ship orders are normally processed according to the timeframe stated in our Shipping Policy.
Processing time is separate from USPS transit time.
Processing and delivery dates are estimates unless expressly stated otherwise. Carrier delays, weather conditions, holidays, service disruptions, address problems, and other circumstances outside our reasonable control may affect delivery.
Customers are responsible for providing a complete and accurate shipping address.
Additional shipping charges may apply when a package is returned because the customer supplied an incomplete or incorrect address.
Tracking information is provided when available.
Our complete Shipping Policy is incorporated into these Terms by reference.
11. MADE-TO-ORDER AND SPECIAL ORDERS
Products identified as “Made to Order,” “Special Order,” personalized, or custom-made require additional production time.
Estimated production times will be stated in the product description, invoice, or written order confirmation.
Production schedules begin only after all required information and payment have been received.
Made-to-order, special-order, and personalized products are final sale and cannot be canceled, returned, exchanged, or refunded except when Con Arte determines that the item was produced incorrectly, arrived damaged, or another remedy is required by law.
12. CUSTOM ORDERS AND BRAND STANDARDS
Con Arte is a Christian-inspired artisan brand. Our products, designs, messages, and creative work are developed within our established brand identity, values, product lines, and artistic standards.
We accept custom orders only within the scope of the products and creative services that Con Arte chooses to offer.
We may decline a custom request that would require us to create, alter, reproduce, incorporate, or provide:
- Wording or messages we do not offer
- Symbols or themes outside our established brand
- Designs inconsistent with our creative standards
- Packaging or promotional content outside the services we provide
- Material that is unlawful, misleading, infringing, offensive, or inappropriate for our brand
- A project that exceeds our production capacity, schedule, equipment, or available materials
This policy concerns the content and scope of the requested creative work and applies consistently to all customers.
Products available in our regular catalog may be purchased by customers on the same generally applicable terms.
A custom order is not accepted until Con Arte has confirmed the project in writing and received any required payment or deposit.
If Con Arte declines a proposed custom request before accepting it, no obligation to produce the requested work is created.
If Con Arte collected payment for a custom project and later determines that it cannot accept or fulfill the project, the applicable amount will be refunded.
13. INTELLECTUAL PROPERTY
Unless otherwise stated, the Site and its contents belong to Con Arte or are used with permission.
Protected content may include:
- The Con Arte name and logo
- Product names
- Product descriptions
- Photographs
- Graphics
- Artwork
- Labels
- Packaging designs
- Workshop manuals
- Educational materials
- Recipes or formulas disclosed as protected instructional material
- Videos
- Written content
- Website layout and design
You may not reproduce, copy, distribute, sell, publish, modify, create derivative works from, or commercially exploit our content without prior written authorization.
Purchasing a product, workshop, manual, mentoring session, or other service does not transfer ownership of Con Arte’s intellectual property.
14. WORKSHOPS, COURSES, AND MENTORING SERVICES
Workshop registrations, deposits, mentoring sessions, educational services, and reserved appointments are subject to the specific terms stated in the applicable product or service description.
Unless otherwise expressly stated:
- Registrations and deposits are final and non-refundable
- A deposit reserves a place or appointment and is applied only as stated in the applicable listing
- Failure to attend does not automatically qualify for a refund, credit, or transfer
- Rescheduling is available only when expressly permitted by the applicable workshop or service terms
- Participants must follow all safety instructions
- Con Arte may remove a participant whose conduct is unsafe, disruptive, abusive, or materially interferes with the class or other participants
Educational information is provided for instructional purposes. Participation does not guarantee business results, sales, profits, regulatory approval, product success, or mastery of the subject.
Workshop materials may not be copied, recorded, distributed, taught, resold, uploaded, or reproduced without written permission.
15. REVIEWS, PHOTOGRAPHS, AND USER CONTENT
Customers are responsible for the accuracy and legality of reviews, comments, photographs, and other content they voluntarily post publicly through the Site or related platforms.
By submitting a public review or publicly posted content directly to Con Arte, you grant us a non-exclusive, royalty-free license to display and reproduce that public content in connection with our business, subject to applicable law.
We may remove or decline to publish content that is unlawful, fraudulent, threatening, defamatory, obscene, misleading, infringing, abusive, or unrelated to the product or service.
Photographs or documentation submitted privately for customer service, damage claims, or dispute review will not be used as marketing content without permission, but may be retained and used as necessary to evaluate the claim, communicate with payment providers or carriers, respond to a dispute, comply with law, or protect our rights.
16. THIRD-PARTY SERVICES AND LINKS
The Site may include services, payment options, applications, content, or links operated by third parties.
Third-party services are governed by their own terms and privacy practices.
Con Arte does not control third-party websites and is not responsible for their content, availability, security, or practices.
Customers should review the applicable third-party terms before using those services.
17. PRIVACY
The collection, use, retention, and disclosure of personal information through the Site are governed by our Privacy Policy.
By using the Site, you acknowledge that you have reviewed the Privacy Policy.
18. FRAUD, ABUSE, AND SECURITY
We reserve the right to investigate transactions, communications, accounts, or conduct that reasonably appear fraudulent, unauthorized, abusive, deceptive, or inconsistent with these Terms.
We may preserve relevant transaction records, photographs, communications, tracking information, account data, and other documentation when reasonably necessary to:
- Review a claim
- Prevent fraud
- Respond to a payment dispute or chargeback
- Communicate with a carrier or payment provider
- Enforce our policies
- Comply with applicable law
- Protect Con Arte, our customers, or others
We may refuse future transactions or restrict access for legitimate and lawful reasons, including documented fraud, abusive conduct, threats, repeated policy violations, or misuse of our services.
19. DISCLAIMER OF WARRANTIES
We make reasonable efforts to maintain the Site and provide accurate information.
However, to the maximum extent permitted by applicable law, we do not guarantee that:
- The Site will always be uninterrupted or error-free
- Every feature will always remain available
- All technical errors will be corrected immediately
- Product availability will remain unchanged
- A product will meet every customer’s subjective preference or expectation
The Site and its content are provided on an “as available” basis, subject to any warranties, guarantees, or consumer rights that cannot legally be excluded.
20. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Con Arte will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of the Site or services.
Nothing in these Terms excludes or limits liability, warranties, obligations, or consumer rights that cannot legally be excluded or limited.
When liability may legally be limited, Con Arte’s liability relating to a transaction will not exceed the amount paid for the product or service giving rise to the claim, except when applicable law requires otherwise.
21. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold Con Arte harmless from third-party claims, losses, or expenses arising from:
- Your unlawful use of the Site
- Your violation of these Terms
- Your infringement of another person’s rights
- Fraudulent, abusive, or unauthorized activity carried out through your account
This section does not apply to losses caused by Con Arte where liability cannot legally be excluded.
22. EVENTS BEYOND OUR REASONABLE CONTROL
Con Arte will not be responsible for delays caused by events beyond our reasonable control, including severe weather, natural disasters, carrier interruptions, utility failures, governmental actions, supply shortages, emergencies, or widespread technology disruptions.
This section does not eliminate any obligation to communicate delays, issue legally required refunds, or comply with applicable consumer-protection requirements.
23. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed when necessary.
The remaining provisions will continue in effect.
24. NO WAIVER
A failure by Con Arte to enforce a provision of these Terms does not waive the right to enforce that provision later.
25. ENTIRE AGREEMENT
These Terms and the policies incorporated by reference constitute the agreement between the customer and Con Arte concerning use of the Site and purchases made through it.
The following policies form part of these Terms:
- Privacy Policy
- Shipping Policy
- Refund, Return & Exchange Policy
- Applicable workshop, course, mentoring, custom-order, or service terms
When a product or service description contains specific terms that apply only to that purchase, those specific terms will control for that product or service to the extent they do not conflict with applicable law.
26. GOVERNING LAW
These Terms and transactions with Con Arte are governed by the laws of the Commonwealth of Puerto Rico and applicable federal laws of the United States, without limiting any consumer rights that apply under the laws of the customer’s jurisdiction.
27. CHANGES TO THESE TERMS
We may update these Terms periodically to reflect changes to our products, services, business practices, technology, or legal obligations.
The revised Terms will be posted on this page with an updated “Last updated” date.
Changes will apply prospectively from the date they are posted, except when another effective date is required or expressly stated.
